Acceptable Use Policy

1. Introduction
This Acceptable Use Policy ("AUP") governs the use of all services, networks, systems, software, and equipment provided by Phantom Technology Solutions ("Phantom," "we," "us," or "our") to its clients, end users, and any other authorized parties ("you" or "User"). By accessing or using our services, you agree to comply with this AUP. Violations may result in suspension or termination of services, and may also be reported to law enforcement where appropriate.
2. Scope
This AUP applies to all use of Phantom-managed environments, including but not limited to: managed IT services, cloud services, hosted email and communications platforms, remote monitoring and management tools, backup and disaster recovery infrastructure, security tooling, and any networks or endpoints under Phantom's management.
3. Acceptable Use
You agree to use Phantom services only for lawful business purposes and in a manner consistent with all applicable laws, regulations, and contractual obligations. Acceptable use includes:
- Day-to-day business operations and authorized administrative activities.
- Communication, collaboration, and file sharing with authorized parties.
- Use of provisioned applications and resources within their intended purpose.
- Compliance with all internal policies and Phantom security configurations.
4. Prohibited Activities
You may not use Phantom services to engage in activities including, but not limited to:
- Illegal Activity: Any activity that violates federal, state, or local law, including unauthorized access, fraud, identity theft, or distribution of illegal content.
- Security Violations: Attempting to bypass authentication, escalate privileges, scan or probe networks, exploit vulnerabilities, or interfere with security controls deployed by Phantom.
- Malware: Introducing, distributing, or executing viruses, ransomware, worms, trojans, spyware, or any other malicious code.
- Unauthorized Access: Accessing accounts, systems, or data you are not authorized to access, or sharing credentials with unauthorized parties.
- Spam & Abuse: Sending unsolicited bulk email, phishing messages, or any communications that violate the CAN-SPAM Act or similar regulations.
- Intellectual Property Violations: Infringing on copyrights, trademarks, patents, or trade secrets, including pirated software or media.
- Harmful Content: Storing, transmitting, or displaying obscene, defamatory, harassing, threatening, or discriminatory material.
- Resource Abuse: Cryptocurrency mining, denial-of-service activity, or any usage that materially degrades shared infrastructure.
- Circumventing Controls: Disabling, removing, or tampering with monitoring agents, endpoint protection, backups, or other Phantom-managed software.
5. Data Handling & Confidentiality
You are responsible for ensuring that your use of Phantom services complies with all applicable data protection laws and any regulatory frameworks governing your business (including but not limited to HIPAA, PCI-DSS, GLBA, FERPA, and CMMC). You may not store or process regulated data in environments that have not been explicitly approved for that purpose.
6. Account Security
Users are responsible for safeguarding their accounts and credentials. Specifically, you must:
- Use strong, unique passwords and enable multi-factor authentication where available.
- Never share credentials, tokens, or session information.
- Promptly report any suspected compromise to support@phantomts.com or by calling (800) 338-4474.
- Use only company-approved devices for accessing managed environments.
7. Monitoring
Phantom reserves the right (but assumes no obligation) to monitor use of its services to ensure compliance with this AUP, maintain service integrity, investigate suspected violations, and meet legal or regulatory obligations. Monitoring is conducted in accordance with our Privacy Policy and applicable law.
8. Reporting Violations
Suspected violations of this AUP, including security incidents, abuse, or unauthorized access, should be reported immediately to support@phantomts.com or by calling (800) 338-4474.
9. Enforcement
Phantom may, in its sole discretion and without prior notice, suspend or terminate access to any service in response to a violation of this AUP. We may also remove or block content that violates this AUP, cooperate with law enforcement, and pursue any other remedies available under the Master Services Agreement or applicable law. Where feasible, we will notify affected clients before taking action.
10. Changes to this Policy
Phantom may update this AUP from time to time. Material changes will be communicated to active clients. Continued use of services after the effective date of any updated policy constitutes acceptance of the revised terms.
